Terms of use

These are the terms between you and GAJO Creative Ltd for using HALO: the HALO Phone, the HALO Circle app and this guardian dashboard. By pairing a phone, accepting an invitation or signing in, you agree to them.

We have kept them short and plain. Nothing here takes away rights you have as a consumer under UK law.

1. What HALO is, and is not

HALO turns an Android handset into a phone for one person with a closed circle: only the people a guardian chooses can call or message, and only the apps a guardian allows can be opened. Guardians look after the phone from this dashboard; family and carers stay in touch through the Circle app.

  • HALO is not an emergency service. The SOS button tells the phone’s guardians that help is needed, with the phone’s location. It does not call 999. If someone is in danger, call the emergency services.
  • HALO is not a substitute for care. It is a tool that supports the people around the phone user; it does not replace them.
  • HALO depends on the phone. Location, alerts and sync need the handset to be on, charged and connected. Calls to saved people work over the mobile network even when our service cannot be reached.

2. Your account

  • You sign in with a code we email you. Keep your email account secure; anyone who can read your email can sign in as you.
  • You must be 18 or over to be a guardian, family member or carer.
  • You are responsible for the people you invite into a Circle and the role you give them.
  • Tell us straight away if you think someone else has used your account.

3. Being a guardian

When you pair a phone or accept a guardian invitation you confirm that:

  • You are entitled to make decisions about the phone user's phone: you are their parent or legal guardian, a deputy or attorney, or the phone user has asked you to look after it for them.
  • You will use HALO in the phone user's best interests: the least restrictive setup that keeps them safe, explained to them at their level, and loosened as their independence grows.
  • You accept that every guardian has equal standing. Each sees the same information and has the same controls, and deleting the phone needs a second guardian's confirmation when there is one.
  • You will not use HALO to monitor an adult who can decide for themselves and has not agreed to it.

4. Acceptable use

Please do not:

  • Try to get around the phone's protections, or help anyone else to.
  • Send anything unlawful, abusive or harmful through the Circle.
  • Use HALO for anyone without the right to do so (see Being a guardian).
  • Resell HALO or use it to run a service for other people without our written agreement.

If we reasonably believe an account is being misused we may suspend it. We will tell you why and give you a chance to put things right, unless doing so would put someone at risk.

5. The handset

  • You supply the Android handset, SIM and connectivity. Setting the phone up as a HALO Phone wipes it; back up anything you want to keep first.
  • We are not responsible for the handset, the mobile network or WiFi you connect it to.
  • Apps you allow on the phone are made by other companies and come with their own terms. We do not control their content or availability.
  • Removing HALO from a handset requires a factory reset, which returns the phone to an ordinary Android phone.

6. Fees

HALO is currently provided without charge during early access. If we introduce a fee we will tell you at least 30 days in advance, and you can stop using HALO before it applies. Any fee will be clearly shown before you agree to it.

7. Availability and changes

  • We work hard to keep HALO running, but we cannot promise it will never be interrupted. We may take it down briefly for maintenance.
  • We improve HALO over time. If we remove a feature guardians rely on, we will give reasonable notice.
  • We may update these terms. The date at the top shows the current version; material changes are emailed to guardians in advance. Continuing to use HALO after that means you accept the new terms.

8. Ending things

  • You can delete a phone and all of its data at any time from Privacy & data. Where the phone has more than one guardian, a second guardian confirms.
  • You can leave a Circle from the Circle app, or ask a guardian to remove you.
  • To close your account entirely, email support@halophone.co.uk.
  • We may end the service with at least 60 days' notice, during which you can download everything.

9. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law says cannot be limited.

Otherwise, we are responsible for foreseeable loss caused by our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, for business losses, or for anything caused by the handset, the network, third-party apps, or the service being unavailable. Our total liability to you is limited to the fees you paid us in the previous 12 months, or £100 if you paid nothing.

In particular, because HALO is not an emergency service, we are not responsible for harm arising from an SOS, alert or location not being delivered or acted on.

10. Law and disputes

These terms are governed by the law of England and Wales. Disputes can be brought in the courts of England and Wales; if you live in Scotland or Northern Ireland you can also use your local courts. We would much rather sort things out by email first: support@halophone.co.uk.
